It all begins with the Notice

What that means is that the notice a landlord chooses to serve is the foundation for a succesful unlwful detainer Complaint. 

There are many differnent types of notices and each one has its purpose. 

notice to pay rent or quit: simple the tenant has not paid rent and the landlord is demanding rent payment or posession of the property. 

notice to perform or quit: The tenant is in breach of the rental agreement and the landlord is giving the tenant the opportunity to cure the violation or quit the premises (vactae)

Notice to quit: The landlord is demanding for the tenant to leave without an opportunity to cure.

Notice of termination of rental agreement and notice to vacate: the landlord is giving notice that the rental agreement is being terminated and wants the tenant to vacate. 

while it may seem pretty simple both state laws and local laws have made this simple step into a minefiled in favor of the tenants. 

Lets take a simple notice to pay rent or quit. at first glance is should be a no brainer, the tenant owes rent and the landlord is demanding the rent owed. In reality however depending on where the property is located there may be additional rules. Under the most basic State requierments CCP 1161(2) 

a notice must give 3 days to act excluding saturdays sunbdays, and other judicial holidays, state the amount of rent money , the name and number of whom rent may be paid. 

but what about if the property s within the city of los angeles. The notice has even more requierments so downloading a random sample notice of the internet just wount cut it. 

the extra requierments for a notice depends on the locatoin of the property and whether or not it is subject to local ordinances.
